you are the one who brought a legal definition, with an agenda, to a message board. Murder is an act requiring circumstances beyond a mere "killing".
So you must be the smart one.
Give me the courtesy of answering the following, as you sit on your comfy easy-chair, knowing all the details...
1) should cops have been trained on the possibility that the whole call was a hoax? Or is that just hindsight
2) what is it like to be on-scene, where the facts as you know are that there is a hostage situation, with at least one shooting already committed inside the house, and a suspect (likely the caller, likely the shooter) emerges and fidgets and moves his hands from waist to shoulder-high to waist to up high??

He should be trained to what a threat was. No weapon, easily could've executed a hostage for all he knew. That magically would get charges, despite being not so different than what actually occurred.

Well said. As I have stated a few times, the cop went too far, and likely screwed up. Possibly even should face some negligence charges. But given all the facts, to call this a "police murder" shows a lack of basic comprehension of the term "murder".

As it’s become a semi common issue- yes. Additionally they should be trained in assessing scenes on arrival, as well as what’s a reasonable threat. We’ve seen this with improper warrants (serving at the wrong address), pranks, or over exaggerated calls
I haven’t used murder here but I’ll say this — if you want to use a self defense claim in a situation where you have an entire swat team on your side; you sure as hell better show up with an articulable reason your life was imminently threatened and not talk of fidgeting and false reports. “A gun was pulled...” is a jumping off point for that defense.

if the man in the house DID have a gun and the cop missed, leading to the citizen shooting and killing the cop for an illegal attack, would the citizen avoid charges? frick no

Once the hand phaser is perfected, it'll be the bomb. They'll be able to set them on "light" or "heavy" stun. I can even see uses for them besides police work, like, if there's a really long line at the grocery store and you're in a big hurry.

It's pretty scary to think this could happen to anyone, and they could get killed because the cop thought he was in a tense situation.

SWATing is when another gamer calls in a fake 911 report of a murder in progress at his rival gamer's home. The SWAT team knocks on the door of his victim thinking the victim is a crazed killer. In this case the SWAT team actually killed an innocent dude.
