Honestly, I have no ficking idea how anyone could not have done that math or just ask for her DD 214 for verification before she swears in. I don't get these stolen valor fricks that are in the public bullseye. How do they figure they will not get busted at some point? I mean I get the fake Navy SEAL trying to get some at the bar, but a state judge? Holy shite.

I sincerely wish it were. My company commander who won the Congressional Medal of Honor and was later an attorney in Chicago was helpful in getting the federal law passed. Unfortunately, it was found to be an unconstitutional abridgment of freedom of speech by the Supreme Court a few years back and no one is prosecuted under its provisions anymore. I wish you could have her arrested and prosecuted for a federal crime, but it won’t happen.

It is true that the Stolen Valor Act of 2005 was declared unconstitutional because it was too broad and made merely lying about military service a crime. However, the Stolen Valor Act of 2013 more specifically made lying with the intent of gaining a tangible benefit (judgeship, in this case) a crime. The court in Alvarez stated that the law would pass constitutional muster if it were more specific, and the 2013 Act did that. I would be shocked if the current USSC wouldn’t uphold the 2013 Stolen Valor Act.
