I'd be riding my agent's arse over that one. The insurance biz is opaque (intentionally so to say the least).

Doesn't matter what the company ultimately does. His only choice if the other company is refusing is to use his uninsured motorist..

Lol.. they'd attempt... My wife got into an accident with a motorist that did not have insurance. Filled uninsured motorsist Claim with progressive they cut us a check for 48k for our SUV and then another 60,000 in medical bills and they still never went after the driver that caused the accident..

I had a guy hit me in Albertsons parking lot. They confirmed they had footage of the accident but would not give it to me. Thankfully there was enough evidence that his insurance accepted liability without video

Because if so you can file a UM claim with your company they'll fix it then go after the at fault party especially if you have her info and admission of guilt.

Hell yes. They will take it for $3.50 if it opens the door for them to collect attiorneys fees from the liable party and their insurer.

my wife got into an accident in Albertsons parking lot and same thing happened but I told her to tell her insurance to get it from Albertsons. They ended up getting it and we got all cleared

You would be surprised how many people don't have UM\IM. I have 200K. I have a trial attorney friend that told me if you look around at a red light in BR 60% of the drivers either don't have insurance or they are underinsured. Someone that carries the basic liability hits and totals out your 80K suburban won't have enough coverage to either fix ot or replace it.

One of the good laws passed by the legislature is that if you don't have insurance and you are in an accident and the other driver is at fault you don't get to collect jack shite. My SIL found this out a few months ago. An Entergy Truck rear ended her. She thought she was going to make bank but her sorry arse didn't have any insurance on her car. Entergy didn't even have to fix her car LOL.

Stop. This isn’t true. There are tons of things that go on to investigating parking lot accidents. It’s only ever 50/50 if both vehicles are backing at the same time.

Wrong information, UM doesn’t cover property. Collision will cover your vehicle if an uninsured driver is at fault in an accident. Less your deductible
