You think a lawyer is going to take a $3500 property damage claim?

His insurance company isn't going to subrogate a claim of $3500.
Doesn't matter what the company ultimately does. His only choice if the other company is refusing is to use his uninsured motorist..

it was 35K they would. It sucks but its the way the world works.
Lol.. they'd attempt... My wife got into an accident with a motorist that did not have insurance. Filled uninsured motorsist Claim with progressive they cut us a check for 48k for our SUV and then another 60,000 in medical bills and they still never went after the driver that caused the accident..

Filed a claim through her Insurance AllState.
File it through your insurance and let them deal with the headache of collecting.

You can still have them write an incident report they just won't issue citations.
Most places won’t even come out for that unless there’s injuries.

See if the business where the accident happened has footage on their cameras and send it in

I had a guy hit me in Albertsons parking lot. They confirmed they had footage of the accident but would not give it to me. Thankfully there was enough evidence that his insurance accepted liability without video

Quick question, do you carry uninsured/underinsured motorist??
YES

Because if so you can file a UM claim with your company they'll fix it then go after the at fault party especially if you have her info and admission of guilt.
Completely wrong and ignorant advice.

This is the way.

Yes. The woman is not obligated to talk to her insurance company even though she was at fault. What did you not understand?
The hell she isn't. They can deny coverage based on the failure to cooperate clause in the policy.

The adjuster called and left me a message stating they would not be able to pay the claim because their client will not call them back.
because that is SOP for claims, they wont talk to anyone but the lawyers

Did the police report comment on who was at fault?

Hell yes. They will take it for $3.50 if it opens the door for them to collect attiorneys fees from the liable party and their insurer.

my wife got into an accident in Albertsons parking lot and same thing happened but I told her to tell her insurance to get it from Albertsons. They ended up getting it and we got all cleared

You would be surprised how many people don't have UM\IM. I have 200K. I have a trial attorney friend that told me if you look around at a red light in BR 60% of the drivers either don't have insurance or they are underinsured. Someone that carries the basic liability hits and totals out your 80K suburban won't have enough coverage to either fix ot or replace it.
One of the good laws passed by the legislature is that if you don't have insurance and you are in an accident and the other driver is at fault you don't get to collect jack shite. My SIL found this out a few months ago. An Entergy Truck rear ended her. She thought she was going to make bank but her sorry arse didn't have any insurance on her car. Entergy didn't even have to fix her car LOL.

Most insurance will require you to do 50 / 50 in a parking lot accident.
Stop. This isn’t true. There are tons of things that go on to investigating parking lot accidents. It’s only ever 50/50 if both vehicles are backing at the same time.

Wrong information, UM doesn’t cover property. Collision will cover your vehicle if an uninsured driver is at fault in an accident. Less your deductible
