Am I the a-hole, tow truck illegally parking across from my driveway.

So we are moving into a rental for the next yearish or so we can keep or kid in BR high and see how the markets do. We plan to move out of BR in the next 2-3 years and didn't see the point of buying again now.

Anyhow there is this guy with a tow truck that parks directly across from our driveway and it is HUGE. It makes it very difficult to get in and out with moving trucks and trailers. We have asked them (the driver is NEVER there) but his wife to have the vehicle moved and if they could park it somewhere else (like their long arse driveway) or just not directly across from our driveway so we don't hit it trying to get out.

Tonight the driver was home and drinking and we had a couple of loads to get in and it was almost impossible to back into our driveway with the box truck with the obstacle of this truck. So I pull up the municode. Turns out it is illegal to park any vehicle on a residential street for more than 9 hours in a 24 hour period. Well he treats it has his home base for business so the truck is parked their 24/7 unless he is on a call. It also turns out it is illegal to park a tow truck in a residential neighborhood in Baton Rouge.

Since my normal neighborly requests to not block my driveway was ignored I reluctantly called the non emergency number BRPD number and asked if they could just have him move it. He went into all his rights and told them he couldn't park it in his driveway because it was too heavy and would damage the driveway... well bud, residential streets are designed to have commercial vehicles parked all the time either so I guess damaging the streets is OK but not his own driveway? He raised a big stink and apparently knows a few cops being that he works with some as a tow truck driver but the supervisor (yeah the guy was dick enough to get a supervisor out) told me that he was in the wrong but someone would handle it Monday to get above the guys he knows... politics.

I simply just wanted him to not be in the way while we move, but he wanted more. I really was mostly concerned about hitting his truck, but now I just want it gone for good.

Today was the tow truck drivers first citation, but I don't have any faith he is going to have to pay it.

I would out him but I need to find someone that can help. He told the cops he was going to beat my arse when they left and started coming in the street toward me as a was trying to finish cutting my grass until he saw something that made him change his mind. He was yelling and threatening me. Calling me racists and a terrorist with mother frickers thrown in as a adjective for every word.

The words he told to the group of cops before they let him go. "Y'all all know me and I promise you I am going to beat his arse." and they do NOTHING. He said he would take the trespassing and battery charge directly to the cops that he didn't care.

I asked the officer that gave me the report number what I should do and he said I had to defend myself....

What really pissed me off is when he was in the street yelling at me was he was calling my non verbal son a handicap and retard over and over. He said it was because of me but IDGAF about that, you don't call someone with special needs names, they can't defend themselves.

If anyone knows anyone in BRPD or DA's office that can help with the assault and threats in front of BRPD officers I am all ears.

So todays edition.

I was going to wait until Monday to contact the police again and try to speak to a captain but this driver has resorted to blowing his air horn multiple times at my house every time he dispatches are returns.

This a-hole called my kids retarded dyslexic motherfrickers in front of two officers who both didn't hear him scream in in front of them buy my wife heard it from inside the house.

The cops didn't want to do anything or even provide a report so I insisted on a lieutenant coming out. Of course the cops lie and say I am harassing this guy, whatever, I have the report and a new request for the body cams from today.

Thanks for the LSP info, I will get on that soon.

We have been in contact with the Parish attorney. Supposedly body cam footage is being reviewed at multiple levels.

I have to go in person to file a complaint, I think that is utter BS but if it is what I have to do I will. I am not going now, I am going to give it directly to the captain.

I have him on my cameras saying "I done told him and I am telling him in front of y'all I am going to kick your mother fricking arse and that is a threat"

Immediately after this I have a cop telling me on another camera. " I don't think he is worried about repercussions" before telling me that if he comes in my yard to go inside and lock the door.

He owns the truck, he has a commercial lot 3 miles down the road. He has a place to park his truck. The truck isn't the issue. The issue was he was blocking the driveway. Then the issue was he was harassing me and my family after he was told he couldn't block my driveway. I didn't call the cops again once he stopped blocking my driveway, HE CALLED THE COPS ON ME for being legally parked in front of my home and they made me move while they let his illegally parked vehicle stay that he put there after mine was parked. Its a bunch of BS, I don't want to deal with this.

I am sure my future lawyer is telling me to STFU right now but I don't want monetary gains, I want the dude to leave me the frick alone.

I know there were things I couldn't prove in the past so the only tool I had was reporting his truck every time he harassed me.

We are trying to make a plan to exit.

It took 4 months for BRPD to tell him outright that he can never park his truck anywhere in the neighborhood, but they finally told him that today. O/U before he violates it this time?

I don't trust anyone in BRPD right now, I am more concerned about getting away from living in a BRPD district than the neighbor at this point, ain't that crazy.

We had a plan in place for living arrangements but this throws a wrench in it.

NTA. We have a municipal code for a reason. It isn’t the taxpayers’ responsibility to provide storage for his business vehicle.

3. If he works for one of the predatory tow companies and not a "help you when you break down" conpany, he deserves it

Maybe, but I have the next 6 weeks off. He shouldn't have been a dick. Besides, who parks an oversized vehicle directly across from their neighbors driveway for days on end? I thought that was dickish.

You’re not the a-hole, but it’s unlikely your city has the capacity to deal with your concern in any sort of immediate fashion, so you did probably just start a mutiny.

I don’t disagree with you, it’s just one of those situations that can happen with a-hole neighbors. Damned if you do and/or don’t.

Tow truck drivers are the biggest scum ever. Just make sure you don’t shoot him if he sprays water at your moving truck

He's a tow truck driver. No way he doesn't know the rules and he's towed plenty of people in the same situation. Have it towed. It will be awesome.

frick him. I would call the cops every time he is parked there. Residential streets aren’t for long term parking. If it’s too heavy for his that’s his problem not yours.
