Officer Carroll: "No, ma'am -- not possession, unless I find any in your car. I believe you're impaired by the marijuana you've smoked."
Katelyn Ebner: "Okay, so when I do a drug test, I'll be free to go, correct?"
Officer Carroll: "You're going to jail, ma'am. Okay? I don't have a magical drug test that I can give you right now."
The waitress spent the night in jail, had her alcohol server's permit revoked because of the arrest. After four months, prosecutors dismissed all her charges -- because the blood test came back completely clean.

Commanders would not let Officer Carroll talk with us, but they stand behind the arrests. The department doubled-down on their assertion that the drug recognition expert is better at detecting marijuana in a driver than scientific tests. Cobb County says the GBI Crime Lab reports negative when even trace amounts are detected.

it's the departments and feds
they do check points and dwi traps and stuff to get federal money. more you do, more cash they give.
st.louis city got 2 brand new cop cars to do more dwi check points.
feds offer a lot of cash to be dicks to locals, departments are getting stripped of cash from wack job mayors, so they have to get the funding other ways. They then make the department into money makers at locals expense.

Don't get me started on what happened to me with TSA. That was pure grabbing my junk for no reason.

While true you can get a DWI without drinking, all this video shows is how subjective the tests are and they can say almost anything as cause. You'll get it tossed later, but if a cop wants to take you in they will. Fat arse is mad kid got to play college ball probably.

I have very rarely run into cops like that.
I did have a black highway patrol cop pull me over once for going like 20 mph over speed limit when my speed meter said like 5 over and when I ask him about it, he stopped writing and said some shite like “that’s what I said didn’t I” in a very threatening manner rather than offer to show me the radar gun, etc (the fine was nothing until u hit 15 mph over the speed limit), I keep my mouth shut and shared his story with the DA who told me he had a ton of complaints for shite and was a bad cop they would be getting rid of soon and that happened.
I got pulled over once when I was lost as hell going to the hunting camp and had a small arsenal in back of SUV, and guy was Jesus what are you going with all these guns and was clearly freaked out, but after about a ten minute conversation and computer check we ended up trading hunting reports and he gave me great directions.
My last ticket I got for speeding, I explained I snuck off to go hunting and was trying to make it back before my wife busted me, he said he completely understood, and had done the same thing recently, but I still got the ticket. (Lol)

Was a DUI cop for a little over 2 years. Wrote roughly 250 DUIs, have convictions on all but 2, they refused blood/breath and Judge didnt want convict for whatever reason. I just started getting search warrants after that.
I say all that to say there's a lot of special training to really know and understand drunk or drugged drivers. There are many officers that completely screw it up and arrest many who are not under the influence.
Then you have the bad ones who just want the arrest numbers and will make the most BS arrests.
It really is maddening especially when the number of drunk/drugged drivers on the road is so high.

That kid clearly wasn’t drunk or under influence of anything

Light that loser up with a civil false arrest lawsuit.

Fat piece of shite should be fired.

Exactly. The kid blew 0.00. He is a young man with a bright future. Why would you try to frick that up?

The two cops deserve a blanket party.

Cop certainly pushed something that wasn't there. No idea why.

Where was this arrest?

Because they are cowards drunk on power. They can’t find crime, because they are too chicken shite to go into crime riddled areas, so they try to manufacture it. My cop buddy watched this with me. He said, “oh I want to whipped that guys arse so bad”
No really. I mean there are some but the bigger issue is the need to produce “numbers.”

He definitely wouldn’t on patrol. Can’t have cops fighting, but he would check him after. I get your point though.

Thanks, I really needed something to piss me off before the Pels game.

So what is the protocol if you have consumed marijuana a week prior, or day before, but aren’t stoned at the time the cop pulls you over, and arrests you for DWI for marijuana like this kid?
Seems like a pretty big gap in the DWI laws

Lab tests are calibrated, and if it is below "trace amounts" then you CANNOT LEGALLY REPORT THE RESULTS. There is a reason, the test is NOT RELIABLE at those levels. "trace" is measured in ng/mL. Thats BILLIONTHS per mL.

That cop was abusive to that kid. He passed that field sobriety test with flying colors.
