How can 11 jurors get this so wrong?

Because Massachusetts made their law wrong.

In Massachusetts there's no burden of proof on the defendant when pleading insanity.

No Burden on the Defendant: Unlike federal law or most other states which require the defense to prove insanity by clear and convincing evidence or a preponderance of the evidence, a Massachusetts defendant does not have to prove they were legally insane, rather the prosecution must prove beyond all reasonable doubt that they weren't insane..

Its pretty hard to prove a negative such as that.

Whenever this guy is doxxed and his life is threatened, he needs a go fund me. I would donate to help him move. It is going to happen. Progressives are violent.

Also, I can't help but notice these loud mouthed demons waited, what, one day before going to the media to share how evil they are. Unfortunately for us normal people, there are tens of millions of hateful Americans like these women among us. What a disgusting lot. No wonder they support what they support. I would too if I were that ugly and miserable.

Agreed with this part

Terrible law but in this case her ability to distinguish reality from hallucination is not in reasonable doubt. She was able to plan, time directions and routes, and then immediately ask for a lawyer when the police arrived.

She just played the insanity card as a legal tool from the bottom of the deck after killing three children. But her ability to construct a timeline, control the impulse until no one could stop her, and deceive the husband shakes out the insanity defense as nonsense.

This is correct. Even the guy who held out basically admits according to the law she was NGRI

It’s an absolutely horrific law

There were some big personalities in that room. But at the end of the day, it just came down to an inability to move past your convictions."

Yeah no shite.

This is why choosing your jurors is so important. I'd venture to assume that most of the people in there knew how they were going to decide on the case before they stepped foot into the courtroom. And it seems like most of the jurors had their minds made up to not convict her regardless of anything.

i think the problem is the state of Massachusetts is like 80% soy, so its going to be hard to find a good jury.

Oh I have no doubts that the prosecution had trouble fielding a jury they thought they could get a fair trial with. The simple fact that the lady jurors are bitching about how the one dude "couldn't get over the fact that she viciously murdered her children" is evidence of that.

Of course not. All we have is an extremely biased juror saying that he said he had reasonable doubt.

Based on their interviews and statements, I have reasonable doubt that actually happened.

What does any of this have to do with the right or left?

Typically the left is soft on crime and murderers while the right is not. Factor in this trial over a mother murdering her children just happened in a state that just legalized some pretty liberal abortion laws (and had women cheering) plus other things like women on the jury wearing pink. That should about sum it up, but I’m guessing you knew these things

Congress shifted federal law to burden of proof to the defendent because a guy that was able to do all this got off.

Massachusetts refused to change theirs at the same time.

Hinckley got a bus ticket, booked a hotel room, planned, and then executed an assassination attempt. But they couldn't prove 100% beyond all reasonable doubt that he wasnt insane while he did it.

How can anyone prove 100% that someone else didnt hear voices in their head?

"There are women of color sitting around this country in prisons for [murdering their children]. I just wanna remind us to have the pink shirts and the energy for them as well."

Totally insane.

I think that's an obvious misinterpretation of the law. 100% proof has never been a reasonable standard.

The insanity defense has always been selectively considered. The majority of serial killers are criminally insane by some metric but are exactly the type of people the justice system exists to protect others from being killed, raped, or maimed by.

Certainly most women doing crazy shite are possible to diagnose as bipolar or depressed. You just don't have a civil peaceful society if you don't treat them on the basis of their behavior. We can't have a society where men or women can get away with that type of criminality.

Exactly. Thats why most states changed the insanity plea burden of proof to be on the defense rather than the state. Massachusetts needs to change their law
