Were they outside and will said i have a gun and went back to get it and then hayes shot him? This is where im still wondering what happened

If that's what happened then I think Hayes is fricked.

But eye witness testimony of one person isn't reliable. We saw how that was in the St Louis cop shooting case. We will see.

yes but if cops are matching that kind of report with what Will's wife is saying happened then its pretty damning hence the 2nd degree murder charge within about 24 hrs time.

Imagine instead of a car, it was a house. Two men arguing outside the house. Person A says I have a gun inside and then turns to head into their home. Person B cannot just shoot them in the back before they get the gun.

Right?

I wouldn't think so.

but if a witness says Smith said he had a gun and then proceeded to his car... Hayes charges could drop down to manslaughter?

if the guy would have to go into his home to retrieve a weapon, Person B would expected to remove himself from the scene. At least a lawfully carrying gun owner would.

i don't think it really applies to this situation though.

a house is a bit of a different situation. there is less immediacy compared to a car which is small, and has an assumption of being able to produce said weapon quickly and while close to the other person still. walking up to your bedroom and grabbing something out of the center console or under the seat are pretty different standards.
