I know nothing of the law, but wouldn't they say if he felt threatened by Will, he should have got in his hummer and left instead of following him, or does just the threat of the gun throw all of that out the window?

All I can say is one can't threaten one w a gun and then legally able to shoot someone looking to protect themselves from threat made.

you dont have to retreat. how fast could he retreat? they were 10 feet apart at most.

Also, if Hayes was engaged in "unlawful activity", he can't use Stand Your Ground.
Intentionally rear-ending Smith's vehicle (if that was the case) could be seen as both "being the aggressor" and "engaging in unlawful activity".

if you can determine who the aggressor is, sure.
this scenario isnt that simple. Both guys were arguing. Both were irate according to eyewitnesses.

Ok i listened to it again.
Witness clearly states "guy starts freaking out on the guy saying i'm going to fight you " (referring to shooter)
He says will says "get out of here, i have a gun"
Shooter "frick ya'll i got one too, starts shooting him dead"

see here is the thing. No one knows now. We are all speculating things.. you posted this, others posted will brake checked him. No one knows! We can all speculate and assume, but until real facts start to come out we have no idea right now.

listen to witness video again, he says hayes was yelling at will get here i'm going to fight you or something then says will says get out of here, i have a gun, shooter "frick ya'll i got one too". witnesses said shoots him IN THE BACK and dead.
