The attorney for Cardell Hayes, the man accused of murdering former Saints player Will Smith, has said Hayes was calling 911 to report he had been the victim of a hit-and-run before he rear-ended Smith's SUV, leading to an altercation and Smith's fatal shooting April 9. But a review of NOPD logs shows no record of a 911 call made to report a hit-and-run, or any other incident, in the Lower Garden District area where the accident took place and before the time of the Smith shooting, according to a review of police data by NOLA.com | The Times-Picayune. Logs of 911 calls made April 9 show only two calls made from that immediate area late Saturday night: An 11:29 p.m. call to report Smith's homicide at Sophie Wright Place and Felicity Street, followed at 11:33 p.m. by a call made to report a car accident at that exact same location. Surveillance video placed the location of the possible hit-and-run at Magazine Street near St. Andrews Street, more than two blocks away from where Smith died. There's no record of a 911 call reporting anything at that first location late Saturday night. Hayes' attorney, John Fuller, has suggested his client's 911 call would help prove Hayes "was not the aggressor" in the altercation that ended with Smith dead and his wife Racquel shot. Asked about the apparent discrepancy with NOPD's logs, Fuller acknowledged Wednesday that a review of one of Hayes' cell phones does not show evidence 911 was dialed. However, he said he still plans to check the call record of a second cell phone belonging to Hayes, as well as the call log of Hayes' passenger's phone. Fuller said his statement to reporters on Sunday that Hayes called 911 to report the hit-and-run was based on witness statements. Asked if the witness was Hayes, Fuller declined to specify and reiterated the statement came from a witness.
