As soon as any law seeks to put a cap on how much somebody can make, there is a very good chance that it will be judged unconstitutional.

A CBA would almost certainly be instituted. Similar to baseball, luxury tax and all. Protects smaller programs and also doesn’t truly penalize the blue bloods.

They can’t help it if athletes won’t form a union so there can be a collective bargaining agreement

The students would have to agree to a hard cap, which is essentially what a collective bargaining agreement does. If they don’t agree to it, the legislation would be unconstitutional.

They need a carve out for hockey on this here. Junior hockey goes to age 20. The system is NOT set up for 18 year olds to start playing college hockey.

having your value be determined by your availability goes completely against what NIL is supposed to be. The rev share split was supposed to be the only pay for play, the rest of the value should have to come from legitimate NIL deals.

Private entities are not exempt from antitrust or restraint of trade laws

When people start thinking about college football as a zillion-dollar business no different than, for example, General Motors and not something special because of its tradition and the loyalty of its fans, we’ll get somewhere toward coming up with a way forward here.

We are where we are because of all the money that flooded into this mess, but that ship has long sailed over the horizon.

Members of Congress don’t actually write bills. All of that stuff can be worked out in committee and with legislative staff actually writing the technical details. They are going to have hearings in June on it supposedly. It could be a debacle, struck down by the courts, etc., or it could actually be an improvement over the current disaster. Whining about them making an attempt to even go down this path is pretty dumb at this stage.

You’re probably triggered because it’s co-sponsored by Cruz though.

Largest hangup will be the "pooling" of revenue for NIL purposes and the 75% standard which can be accomplished even if every SEC/Big Ten school vote no. They generate a large majority of the would be pooled money. Basically a welfare fund for smaller conferences/schools. Combine that with the super league restriction, and you can see what the intent really is. Use the rich to feed the poor. It's DEI for college sports.

Also the very inconclusive determinate of what constitutes "legit NIL" and who determines it on a case by case basis.

Recruiting college freshmen would be the biggest thing if you can only transfer once
