Some dude sends you THAT in a text and you didn't walk it directly to HR????

I'm definitely someone who wants to solve my own problems but the temptation of watching him get walked out that exact same day would have been far to much for me to pass up. I'd have gone directly to the HR office phone in hand.

I sure am. I'm actually here at work right now. From my understanding, they are still waiting for some information from Verizon and the company who is analyzing his phone, so they can "complete the investigation."

You need to get your phone records and submit them. Make sure you don’t have any evidence of dick pics or something inappropriate at work, but your phone records should be enough to expedite the process.

Additionally, you need to be looking for a new job. It’s not likely this ends up well for you there. Maybe they pay you off or whatever, but it would be best to help yourself and start moving forward imo.

Guys, please evaluate the email I am posting below. I sent it this afternoon, all names are taken out. Please just give me some advice on if you think it covers everything, or what you think I may need to add in a separate email. Thanks

"Good afternoon all, I wanted to take a moment and send this email to you both, voicing some concerns that I have, and frankly have had over the past two or more weeks. I reported the incident nearly a month ago, and I understand investigations may take time, but I am concerned with the time frame, and it's direct affects on my ability to feel safe and secure while at my job. For example, earlier this year, a similar incident took place, where an employee was found to have threatened another employee with physical violence. That employee was released from the company within 24 hours of the incident. We are approaching a months time, and not only do we not have any updates, but the person who threatened me with physical violence, emotional distress, and frankly blatantly voiced his intent to ruin my career for his own personal pleasure is allowed access to the facility, allowed to freely move about the facility at his whim, and ZERO precautions are taken to prevent him from having unadulterated access to me while I am at work. If I am afforded any rights while at work, I see the right to be safe and secure from physical and mental harm as the most basic of those. I am, at this moment, officially expressing the fact that I feel unsafe in that facility while this person is present. Thank you for your time."

Just my two cents but I’d remove the reference to the earlier incident, “unadulterated”, and “If I am afforded any rights while at work”. Keep it as wide an accusation as you can so they can’t come back and say “well, you only pointed out XXX”

Instead of claiming this moment to be the instant you’re giving them official notice, I’d say something like “you’ve been aware that this is an unsafe environment since 1 July 2022 (or whatever it was), yet I have seen no evidence of any satisfactory action which has addressed my concerns”

But also what does your lawyer think? Curious on what he’s told you so far, and he probably has a better insight into how to phrase things

Speak to your attorney. You selected them. You are either paying them or have a contingency agreement at settlement/conclusion of trial. They should be guiding you and every action of yours be deliberate to self serve.

Exactly. The OP can send it, but the attorney either advises him what to write or writes it for him and he just signs his name to it.

I’d like to see this work out for this guy. And although I like hearing how it’s going, he needs to just update the people here who are interested (and hopefully cheering for him), but don’t ask any of us what we think or what we’d do. Your attorney is the one you need to seek guidance from. Please take that advice… and the very best of luck to you.

So, while I did have an attorney who was giving me some initial advice and direction, this attorney did not specialize in Employment Law. He gave me some numbers to call of others he thought may have employment law experience, but none of them worked employment law either. It turns out that Employment Law attorneys are pretty damn hard to find, and most attorneys apparently realize that the financial aspect of such a specialty is far outperformed by personal injury, divorce, real estate, and other more lucrative areas of law. Basically, I have yet to find any attorneys in my area who work these types of cases. For example, one guy who gave me some advice on moving forward, told me "We get probably 5 or more of these calls a month man. And while I believe most of them, as you can tell who is being honest and forthright for the most part after a quick initial interview over the phone, it unfortunately just isn't worth the time investment on our end. We have to pick and choose our cases, and these types of cases can drag on for yours, and result in settlements that simply do not justify that type of time and resource investment." I really have no choice but to go solo, until I find an attorney who is willing to take this on, but I've had zero success with that so far.

Wow. I’m sorry to hear that. I wish that you were in my area. I’d at least have you sit down with my long time attorney for advice on what you should do (or not do). Employment law isn’t one of his areas either, but he could alert you to potential legal pitfalls of saying or doing the wrong thing.

Well fellas, here's the latest. As of COB yesterday, I am no longer an employed with this company. So, I was contacted by an attorney representing the corporate office yesterday morning, and after a lengthy conversation, the matter was settled. I am now contractually prohibited from sharing the details of the separation, and many other things. Bottom line is, I'm moving on with a smile on my face!!

This is probably less about "ostracizing" and more about keeping their mouths shut in the face of potential litigation on advice from their attorneys.

I would not automatically assume it's bad. Very well could be, but it also could be "we had to 'go dark' until the legalese was finished. They may want to talk/interact more normal, but can't.
