However, surveillance video at the stadium revealed that Tilotta and the men placed the beer inside a black pickup truck that belonged to Tilotta. Per WBRZ, the officers traced the truck to Spruce Hall, a residential community on the university’s campus that houses 400 first-year students from the College of Engineering.

When officers arrived at the residence hall, Tilotta gave them permission to search his room where they found the stolen cases of beer.

I would have the records subpoenaed for the wholesale price that concessions actually paid for beer and then seek a lesser charge.

It’s still felony burglary no matter the value of the thing stolen. That said, I assume they would let the kid off with a misdemeanor or Pretrial Diversion

What they serve in the stadium isn't beer. He should be charged with stealing flavored water.

There's about a zero percent chance $1500 is the amount that will stick. The victims in these cases always give out inflated numbers for stuff like that. Even at retail prices in the grocery store for craft beers, $1500 is probably 7-8X what they are probably worth. ~$2 a beer x 3 cases (24/case) = $144

They're very likely citing bullshite stadium charges of $10/beer they would have made if sold. Because 72 beers @ $2/beer would be just shy of $1500.

No its not. Simply burglary is a misdemeanor. For it be felony aggravated, a firearm would need to have been possessed. Regardless, they shouldn't have even been charged with burglary. For them to have been charged with burglary, they would have needed to have an unauthorized entry into an inhabited dwelling with the intent to commit a theft or other felony. Tiger Stadium is not an inhabited dwelling.

What they should have been charged with was simple theft and criminal trespassing, both misdemeanors

You don’t know what you’re talking about.

Simple burglary is a felony.

You can be convicted of felony burglary even if you don’t steal anything. But if you enter a place/business/car/home without authorization with the intent to commit a theft therein, it’s felony burglary.
