Variable surcharges are common in many industries. I can see how it's making it's way to dining with how much things are fluctuating in an upwards trajectory.

They also charge fees when using debit cards. Which I think is illegal. Must be hurtin.

Florida has a new law effective July 2026 that requires restaurants and other food service providers to provide prior notice of any general line-item operational charge included on a bill.

The law draws a distinction between “gratuity” and “operational charge.”

Gratuity” or “tip” means a sum presented by a customer as a gift or contribution in recognition of service performed, the payment and amount of which is at the discretion of the customer.

Operations charge means an automatic fee or charge, other than a government-imposed tax, that a customer is required to pay in addition to the cost of the food and beverage purchased. The term includes service charges, automatic gratuities, credit card surcharges, and delivery fees.

Prior notice means the fee must be on the menu, website or mobile application where food and beverage orders are placed, and it can't be buried in small font. The notice must appear in a font that is equal to or greater than the font used for menu item descriptions or the general provisions of the written contract.

Louisiana and other states should pass similar prior notice laws so that customers know before they order that such a fee will be imposed.

The weakness in the Florida law is that it does not create a private cause of action that would allow the customer to sue to enforce it. Good luck getting the state enforcement authorities to do anything about a violation.

at least they are telling you what the fee is and not raising your meal prices

Frank's is still very reasonable price wise these days considering how much other restaurants have gone up

we ate breakfast and it was cheaper than a McDonalds breakfast

plus the service was spot on and food came out quick, so that tells me they are doing everything they can to turn over tables and get more customers while keeping costs lower for the consumer
