I appreciate the explanation without the name calling.
With that said I understand the general outline of what you are saying but fail to understand the FDA specificis driving this policy. However Dr. Malone which is my appeal to authority does apparently understand the specifics. Here is his entire objection:

Yes I knew that but under this EO they will be considered. The USPS union is already pushing back against it or were a few weeks ago when it first came up this might happen.

If I’m mandated to take vaccine and I have an adverse reaction, can a person sue their employer(in this case feds) for damages??

Simply, no. The vaccine manufacturers have had almost complete immunity since the 80s. Even if the vaccine label made a difference (vs simple timing) they have the same immunity under their biologics license that they had under the EUA.

I see a huge problem with it, but probably not the one you're thinking.
It is the same problem I've been harping on for years. We can go a long way to fixing this country if we drastically curtail the power and use of Executive Orders. Our country is little more than a soft dictatorship now, and it has been for a while. End the reliance on Executive Orders and force the Legislature to....you know....fricking legislate!

BioNTech-Pfizer is still under EUA. It is available and this is the Pfizer vaccine that people think is fully FDA approved.
There is a lot of confusion around this issue and it was purposely rolled out this way so it can be said the vaccine is fully approved and still maintain legal immunity from side effects.

They did, as soon as the BLA was approved those vials without Comirnaty on them were FDA approved. Whether you got a EUA or BL approved dose is wholly dependant on the timing and nothing more.
