Where do you stand on bartenders being responsible for their patrons?

Recent case in Houston where 5 bartenders are facing charges for basically over serving. Guy left the bar room and killed a young lady and injuring her child and mother.
I’ve heard other charges of bartenders being arrested for overcharging and thought that was a little much esp in a crowded bar room when they can’t keep up with everyone.
This guy was also 19. Not sure if he had a fake ID. If not, then they are f’ed.

Just from looking at that picture I'd say any bartender should know not to serve that guy anything. But being that he was 19 he also could have had someone buying drinks for him and bringing them back to him.

I mean they may have over served, but I doubt they threw this guy into his running car and waved bye.

That is garbage.
Its not the responsibility of the Bartender to babysit drunks.
Its his job to make money!

Personally, I don't see how you charge a bartender with a crime for doing their jobs. It seems like the next step is for people to start suing the place where the person got drunk.
If this is going to continue being the norm then bars are going to have to employ "exit bouncers" that don't let people leave the bar if they're too drunk to drive unless they have a DD or are taking a cab/uber.

I may be bias b/c I was bartender back in the day, but people are legally adults at 18. Full grown folks should be responsible for THEIR actions.
If I go out and get super fricked up and drive and kill someone, that's on me. No one else.

It all depends on the type of place where the drinking is happening too. If it's at Fred's after a gameday or a high end restaurant on a Sunday night. If you, as a bartender, can tell someone is over served and about to get behind the wheel, I feel they have an ethical and moral responsibility to ensure the guest gets home safe and alive.
On more than one occasion, I had to call cabs/ubers for guests. Now, I did not pay for them, but it was pretty simple, for where I worked, to tell someone if they get behind the wheel we would call the police.

Poncho's should've known not to serve me after I raised the flag for the 13th time to get more enchiladas. They're also responsible for paying for that toilet I broke.

They should be held partially responsible only if they didn't ID him. I really hate this blaming culture we live in now. Only one dumb arse in this scenario chose to consume those drinks and get behind the wheel and should pay the price for it.

I mean, what are you supposed to do? Follow the patron out the door to make sure that are not going to drive? Not the responsibility of the bartender.

My only experience was 15 years ago in LA, but we had to get a liquor license to serve/bartend, so there was a bit of training involved.
If there's something like that in TX, I'd say the bartender could possibly be proven to actually know or should have known (provided he was actually serving the patron directly).
Definitely a slippery slope though. Morally, of course the bartender should try to intervene. I don't agree with legally requiring babysitting of adults.

I have had friends cut off multiple times. I was always happy when they were cut off. Hell, we got kicked out of the chimes on gameday as our friend was that drunk.

It's such a gray area IMO.
Why isn't Kroger held responsible for selling a 12 pack to a guy who is who just came in from the club at 12am? Why isn't Budweiser held responsible for making beer that people drink that kill people????! Could go on forever like this.
