I'm also in the personal accountability camp. If you frick up, guess what? It's not somebody else's fault.
Several years ago, the home brew club I'm in volunteered to pour beer at a beer festival here in town. Some breweries only send beer, not people, to these things so they need volunteers to pour for them. We had to take a class on how not to over serve and what to do if a guy was clearly shitfaced. After the fest, word came down that one of the volunteer servers who was not in our club got hit with a $500 fine for over serving somebody. After that we said frick it. Pour your own beer.

Some of you are morons. How is it not the bartenders fault that a 19 year old was served 12 drinks without being carded once?

It's still a legally sold product in both instances. It's just another attempt in modern society to lessen personal responsibility for one's own actions.

I realize you are playing devil's advocate, but how can you reasonably expect 2-3 bartenders to keep track of a couple hundred patrons drink count and physical state on a busy Saturday night?

I’m not playing anything. They were charged with serving to a minor and serving an unauthorized beverage. They have a beer and wine license and served him tequila.

Can we talk about the situation at hand?
6 hours drinking, on a Sunday, including taking shots with the bartenders. Never carded once. The bartenders are serving liquor, something they're not allowed to do under their license - only beer and wine.
In this PARTICULAR instance, they share some of the fault IMO.

A friend had to deal with this bullshite back in the early 2000's. He owned a bar and 3 frat bros were drinking on the night before Thanksgiving. They started off at his place, had a few drinks and went on to other bars throughout the night. Think Parkway or Par 4's was the last bar they were at before they drove home at like 4am and got in a wreck on I-10 killing 2 of the guys and paralysing the other.
My friend that owned the first bar they were at got sued by the parents. Didn't matter that it was about 7pm when they were there and only had a couple of drinks, his insurance settled. Some huge BS imo

Exactly. They were charged with what THEY were reaponsible for: serving of age customers and serving only what their license allows them to serve.

What if a gun store sold weapons to a known terrorist? Should he be at fault for what happens with those weapons - weapons that wouldn't be in the hands of the terrorist if they gun store clerk asked for his ID and ran the appropriate background check?
ETA - I'm not suggesting they're the exact same situation, just trying to understand the logic.

I’ve seen customers walk in and order a beer and seen perfectly normal, then after serving you realize they are way too fricked up. Or get someone else handing them drinks.
I’ve seen people who can black out after 2 drinks, or can get into drunk accidents after a normal amount of drinks. Theres no singular line or point of intoxication that is easily identifiable and customers will always lie about how they are getting home.
There are times when we would be in the bar completely alone, and you’re expected to leave the bar unattended every time a drunk person walks out the front door?
It’s just an absurd law and expectation.
As have I when I was in the industry. It takes a special situation, like this one, for someone to actually get charged. Hell, I remember a few years back when a person on a bike was killed by a drunk driver leaving Bulldog and people were concerned the bartenders may get in trouble in that situation.
It is only special occasions that this law comes into effect because of extreme situations. If the law started going after every drunk driving situation, then there is an issue. In this particular case, the bartenders are taking shots with the guy, watching him drink for 6 hours and he hits the woman almost immediately after leaving, which is why they are being charged.

It certainly can. If he was serving to an underage drinker then that's on him. But in general, I don't think it's fair to hold a bartender responsible for something that a patron did after he left the bar.

I'm not saying it's easy or right to punish you. I'm just saying that's how you get fricked. They can say they trained you. I probably served a ton of underagers back in my day.
