do you have collision and comprehensive?

If so your insurance will go after her.

Do you have liability with Uninsured motorist? then see above.

If you have liability only a civil suit is your only option.

Uninsured motorist coverage only covers bodily injury, unless you have UMPD.

If you have comp/collision coverage you can't carry UMPD. If you have comp/collision coverage your only option would be to file a claim on your insurance, get your car fixed, then let your insurance sort out the details. You could file civil suit but if she can't pay premiums then she probably can't pay you.

While UMBI is great to have, it amazes me how many people have no clue what they are talking about or buying when it comes to coverages.

its like this. if you have full coverage your car will get fixed period. if only liability you get nothing.


this is louisisna you have to always have uninsured motorist property damage for all the retards with no insurance. it will also cover a hit and run which is great. because most without ins will hit you and run.

i was in someones car one time and tapped someone at a red light and the car i was in didnt have ins. they got their car fixed and sent me the 3500 dollar bill. and it flagged my license so i had to go into a installment agreement and make monthly payments to get the flag off of my license.

"Full coverage" is a very loosely used term in the insurance world. A lot of people are sold "full coverage" to mean "enough to satisfy state minimums". Please check your coverages carefully before assuming full coverage means the whole universe of options out there.

THIS and yes, it pissed me off to no end. I did get the a-hole in the end. He was charged with a DWI, but his Dad had some pull. I didn't let off and pushed the DA on the case till he had to go to court. Judge threw the book at him for third DWI.

Good luck is all I have to say. A guy totaled my car a couple years back and had no insurance. I've gotten a whole $100 out of it. (Paid $1000 deductible for my insurance to cover )

I got an estimate for the damage, but before I could get it repaired, she was rear ended by someone else and the vehicle was totaled. So, the driver of the vehicle that hit her this time was insured and I was paid for the vehicle.

People here do realize that your insurance company will still pay for your vehicle minus your deductible if you get in an accident with someone w/o insurance.
