UPDATE from another news station. They're now saying Delta Chi, alcohol, and she caught a sexually transmitted infection (STI)

According to an affidavit, LSU Police detectives were notified on April 9 of an alleged sexual assault complaint at the Delta Chi fraternity house.
The victim told authorities that on April 2, she had been drinking and lost her memory. The following day, she said she woke up outside of a man’s room, later identified as Phoenix Hernandez, 21. She reported she had no recollection of how she got there or when she left the bar the previous night.
After a failed attempt to contact Hernandez, the victim left the area and went to a nearby friend’s apartment.
The affidavit states the victim called Hernandez to ask what happened, and Hernandez responded that they only kissed and nothing further. After persistent questions, Hernandez admitted that the two had sex. After learning of this, the victim had a sexual assault kit performed, which resulted in the positive test result of a sexually transmitted infection (STI).
On April 15, Hernandez was detained and brought in for questioning. Hernandez said he was “hammered” several times when asked about the events on April 2. He also said he didn’t remember any intimate acts other than kissing taking place. He added that the two ended up in his bed before they fell asleep. Hernandez agreed to a device search of his cell phone.
On April 16, investigators found a voice message that was sent to Hernandez’s roommate. The recording was sent on April 3, describing having sexual relations with the victim in an alleged boastful manner.
Hernandez is wanted on a charge of third-degree rape.

Let me help you out:
§43. Third degree rape
A. Third degree rape is a rape committed when the anal, oral, or vaginal sexual intercourse is deemed to be without the lawful consent of a victim because it is committed under any one or more of the following circumstances:
(1) When the victim is incapable of resisting or of understanding the nature of the act by reason of a stupor or abnormal condition of mind produced by an intoxicating agent or any cause and the offender knew or should have known of the victim's incapacity.
(2) When the victim, through unsoundness of mind, is temporarily or permanently incapable of understanding the nature of the act and the offender knew or should have known of the victim's incapacity.
(3) When the victim submits under the belief that the person committing the act is someone known to the victim, other than the offender, and such belief is intentionally induced by any artifice, pretense, or concealment practiced by the offender.
(4) When the offender acts without the consent of the victim.
B. Whoever commits the crime of third degree rape shall be imprisoned at hard labor, without benefit of parole, probation, or suspension of sentence, for not more than twenty-five years.
C. For all purposes, "simple rape" and "third degree rape" mean the offense defined by the provisions of this Section and any reference to the crime of simple rape is the same as a reference to the crime of third degree rape. Any act in violation of the provisions of this Section committed on or after August 1, 2015, shall be referred to as "third degree rape".
