Is the most likely scenario that she she's claiming to have been too drunk to consent? Yep. Are there other possible scenarios? Yep. Do any of those scenarios involve minors? Nope. Is the statute difficult to read? Also nope.

I'd say that was true way past 2000 and into the 2010's.

Last year's Chi O president was a black girl. It's not your father's or even your uncle who was more like an older cousin's Greek system. Although minorities are still very much in the minority.

In the not too distant past, BRPD had a female detective who specialized in turning mutually drunk sex cases into rape cases. One of the things she would do would be to have the “victim” call the guy and jump his arse. On a recorded call of course. Because she knew that young guys would automatically apologize just because that’s a natural response to a hostile female. She would then use the apology as a basis for a prosecution showing the guy “knew” he was wrong.
No admittance to rape but just the inference based on the apology.
I heard about this from a defense attorney buddy who fought one of these prosecutions and only managed to get the defendant cleared when the girl recanted just before trial.
Fast forward a couple of years and a buddies son had very consensual drunk sex with a girl at LSU. He had the before and after sext messages to prove it. Then he stopped seeing her and she proceeded to make rape claims. My buddy and I talked to him and I warned him against talking to her on the phone. Not a day later, she called and did try to get him to apologize. He was subsequently interviewed by the female detective.
Watch yourself out there.
