WASHINGTON (AP) — Federal immigration officers are asserting sweeping power to forcibly enter people’s homes without a judge’s warrant, according to an internal Immigration and Customs Enforcement memo obtained by The Associated Press, marking a sharp reversal of longstanding guidance meant to respect constitutional limits on government searches.

The memo authorizes ICE officers to use force to enter a residence based solely on a more narrow administrative warrant to arrest someone with a final order of removal, a move that advocates say collides with Fourth Amendment protections and upends years of advice given to immigrant communities.

So...they still have a warrant that grants them the power, just not from the activist judges the AP wants.

*illegal immigrant communities, and how is this ANY concern of ICE?

I see the problem. If you have a final order of removal, the advice should have been to pack yo shite.

The things that MAGA has rejected is getting stunning

Capitalism
Non-interventionism
States' rights
Textualism
....now the 4th Amendment

An administrative warrant is not the same as a search warrant for 4A purposes.

The 4th Amendment still applies to ICE

I mean it’s pretty clear if you asked these guys if they want fascism they would say no.

If you asked them if they wanted a strong executive who doesn’t put up with shite, exacts retribution on political foes, and exercises central government control over cultural issues they agree with all with a strong nationalist bent, they would say yes. They would say any congressional member or judge who tries to stop this man is an enemy to the people.

It’s called probable cause. LEO’s have always been allowed to forcefully enter a home with probable cause, without a warrant.

ETA: I was wrong. I try to always admit when I’m wrong.

As lothed as i am to agree, SFP is correct there. 4t Ammendment shite fascinates me and i spent alot of time learning both sides. Lae Enforcdment cannot violate ghe curtlage of a home let alone enter without a search warrant. An arrest warrent is insufficent to enter.

Forego the law to save the nation. Ah yes, that refrain has never been used in history.

We should probably just jail everyone to ensure no one else gets raped or murdered.

The OP indicates that an administrative warrant is still required.

They’re going to use the constitution to allow the country to be destroyed. And it looks like a lot of SFP posts and this:

quote:

If you asked them if they wanted a strong executive who doesn’t put up with shite, exacts retribution on political foes, and exercises central government control over cultural issues they agree with all with a strong nationalist bent, they would say yes. They would say any congressional member or judge who tries to stop this man is an enemy to the people.

The founders never believed that the constitution could work if the people hated the country. It was never supposed to be without qualifications and limitations.

“Neither the wisest constitution nor the wisest laws will secure the liberty and happiness of a people whose manners are universally corrupt."
Sam Adams

"We have no Government armed with Power capable of contending with human Passions unbridled by morality and Religion. Avarice, Ambition, Revenge or Gallantry, would break the strongest Cords of our Constitution as a Whale goes through a Net. Our Constitution was made only for a moral and religious People. It is wholly inadequate to the government of any other."
John Adams
