Modified comparative fault (51% on plantiff = complete bar)

Modified No Pay/No Play (now 100k BI and 100K PD if not insured)

No more Housley presumption (presumption of causation)

Collateral source is the great unknown at this point. They're running out of days in session.

Nothing on future meds? These look great, but probably won't do a lot.

His detractors will still complain while continuing to lose elections because they have no better candidate nor plan.

This could be huge if the insurance companies tell the billboard lawyers to pound sand.

This and the 100/100 NP/NP will definitely chip away at some of them and make them wary about taking borderline cases. But there'll be some bottom feeders that will still roll the dice.

Collateral source and future meds are where the real meat is.

I voted for Landry, but he is not the Republican I wanted. I am more disappointed than I could have imagined. He is a caricature of a conservative southern governor, beholden to himself first and secondarily to the plaintiffs attorneys who funded his campaign, and I have seen nothing to indicate that he is interested in discussing serious solutions to our state's serious problems.

Why do I get the vibe that all of these reforms were given the green light by Gordon before being allowed to be put in a bill by the Legislature and then signed by Huey Short.

Probably because he did.

No doubt.

Everything he signs is the product of the Texas Summit

They're pretty bad then too, unfortunately .

Best to live your life in a way that you never have to rely on one.

When should we expect relief on insurance rates?

ChatGPT translation for us non-lawyers:
quote:

Summary of Proposed Louisiana Tort Reforms (2025) and Potential Insurance Impact:

Modified Comparative Fault (51% Bar):
If you're 51% or more at fault in an accident, you can't recover anything. This should reduce payouts by insurers and could help lower auto premiums.

Expanded No Pay/No Play:
Uninsured drivers are barred from collecting unless damages exceed $100,000 (bodily injury or property). This pushes more people to carry insurance and improves the overall risk pool.

End of Housley Presumption:
No more automatic assumption that a medical condition shortly after an accident was caused by it. Makes injury claims harder to prove — reduces inflated payouts.

Collateral Source Rule – Still Unclear:
Lawmakers might change how much of a plaintiff's medical bills are recoverable if insurance or other sources already paid. If it changes, insurers could owe less.

Impact on Insurance Rates:
If all these reforms pass, expect fewer lawsuits, smaller claims, and more insured drivers. Rates probably won’t drop overnight, but this could lead to real savings over the next 1–2 years — especially on bodily injury coverage.

Not being addressed?
quote:

The current tort reform bills (fault limits, no pay/no play, etc.) are good, but they’re not addressing the medical billing scam, which is a huge part of the problem. Injury lawyers send clients to certain doctors who skip insurance and bill at inflated rates through liens, then use those fake prices in court to boost settlements. It’s legal, but it’s driving up everyone’s insurance premiums — and nobody's fixing it.

Yes, there are those out there that hate him irrationally. But can you offer reasons to like him? Seriously, give those of us who dislike him the reasons we should. A quick balance sheet, if you will.

How? Don't they usually take cases with 100% liability almost exclusively?

The no pay no play limits is awesome. F uninsured drivers. The state needs to up the minimum insurance requirement as well- 15/30 does absolutely nothing.

Sad reality is they can do all this but the insurance companies won’t lower premiums. Why would they? We pay it. Both sides are corrupt as hell but they need each other to survive.
