Desantis raises interesting death penalty issue

OK, I'm not interested in whether DP should be abolished. We've rehashed this enough on the board. This has to do with jury numbers.
Desantis proposed that unanimous requirement should be replaced with 8 of 12 guilty votes = death sentence.
It was motivated by a trial where the killer got off with 3 dissenting (9 of 12 guilty).
So, my question is....If you favor the DP what should the vote be? I've always been in favor of the DP. I've always been opposed to unanimous. But before reading about this issue I've advocated for 10 of 12 = death.
Thoughts?

That should not only put him out of the race but be labeled anti-constitutional.

Narrow the scope... if there are eye witnesses and the killer is caught at the scene, or fleeing from the scene where there is NO question who that person is ... the majority vote should be sufficient as it would be obvious that some would not be following the law. Might could expand to video where there is NO possibility of it not being that person. So, 7-5 would be ok.

maybe for other things, but when it comes to death penalty the bar has to be higher, i am not for unanimous verdicts but it should require at least 11 of 12 or do life in prison.

With DNA testing we've seen many times that the state got the wrong man.
The death penalty should be reserved only for politicians.

Not to say he doesn’t deserve the electric chair but the system failed that kid on every level. I can see why jurors felt he didn’t deserve the ultimate punishment.

Just clarifying, this is after a unanimous guilty verdict. The jury then has to determine if they get the axe. Should the penalty phase also be unanimous

Please note that it used to be this way in Florida and only recently changed to require unanimity from the jury.

I am pro death penalty but believe it should only be on the table if DNA evidence is available. Far too many cases of people being exonerated because of corrupt cops and/or DA's who were too lazy to pursue other leads and simply wished to close a case. And when we are talking about executing people, the vote should be unanimous. In addition, the death penalty should be expanded and used as a punishment for sexual assault of children and aggravated rape.
