Gross. And the moral decline of society continues. I weep for the future and the world my descendants will live in.

Maybe teach your kids to look for quality relationships instead of just hookups with wasted chicks or prostitutes. What to look for in a prospective match/future partner etc. Values, morals, intelligence, ambition, family plans...not just "willing" and "vagina".

In this case there were 4 males in that car. Surely at least one was sober enough to make the determination that she was too impaired and stop it. What about the driver?

I used to pick up women at bars when I was younger, and I don't ever recall this "consent" thing really being an issue. It kind of reminds me of pedophilia... we went from "who would ever want to mess with kids sexually?" as a societal consensus to pedophilia as a widespread phenomenon.

I can't help but think that both things are examples of mass hysteria fueled by a very small group of people who somehow managed to gain access to the media. Similar to Covid, white supremacy, "incels," etc.- manufactured crises.

This is not to say that people don't rape, or mess with kids. They do, but they 1) do so in smaller numbers than the media seems to suggest; and 2) do so to a greater extent than they would if the media would STFU and cover larger issues.

So if you are asking in context of the Brooks case...I could see it.

If you are saying in general my question would be is did either get a blood test? Did either party get even a breathalyzer? Are the courts going to accept personally owned breathalyzer product results?

I think the thing with the current case is the ultimate outcome of the crime was that the victim ended up deceased. That is why we got a decent reading on her BAC I'd assume. I'm not sure that will be the case for most alcohol consent (or lack thereof) based rape cases.

Yea .32 is beyond drunk.

However the question is what level of impairment legally means you cannot consent? .15? .20? .08 like it is for driving?

If rape is going to be charged for someone very drunk but not passed out, then I think the law needs to set an actual standard. If you leave it up to a judgement call it leaves too much room for interpretation. Good lawyers will get guilty people off free and innocent people put in jail just because they took home a girl who was tipsy but consented and regretted it later. It needs to be clear cut because a guy shouldn’t go to jail for having sex with a girl after a few beers nor should one get off free because a good attorney argued consent even though the girl was barely conscious
