And just FYI, rape (in all forms) requires a general intent, not specific intent.

That I got....however aren't we talking about 2 victims and 2 offenders if both parties are above the BAC limit since neither can give consent?

What a dad. Instead of teaching values, you just teach him how to avoid trouble.

Teach your kid personal responsibility and he'll make the right choices.

Exactly. Since both are legally drunk neither can give consent. So technically the woman would be raping the man as much as the man was raping the woman. So what would happen?

What if both parties are drunk? Legally then neither side could by the law legally consent to sex. As I was thinking about this in regards to my son it means by the law a whole heck of a lot of us (probably all of us at some point in college) could legally be accused of rape.

I'd think it would come down to the results of the rape kit, if any injuries are consistent with what is normally expected in a rape situation, if the investigator thinks the accuser is credible, etc.

I feel like I've tried my best to and it's probably just me overreacting to him going to college. But worse case if he that urge to do a one night stand I'd rather go the escort route than a woman change her mind later.

I'd rather him wait until marriage before sex or at least a relationship but I'm also not naive. I know in college the urge will be there to hook up.

As a parent, you are an idiot
As a son, let's hope he has more common sense than you
You do realize an escort may give your son a STD

One has to be the offender otherwise there’s no crime.

Are you saying a person has to be an offender (via breaking laws) for a crime, or that ONLY one of the 2 can be an offender? Because the 2nd part is wrong.

What if both suffered injuries that could be consistent with rape?

With the standard now being that someone can legally claim rape due to not being able to legally consent due to being drunk I see it opening up a whole can of worms going forward.

What? You think this case set the precedent, when the trial hasn't even started yet?

All the dudes involved need to say they are trans

Then they are higher on the PEMDAS rape consent priority ladder

Why would this matter? This is about both parties' inability to consent. It could be the softest, most vanilla sex or the hardest, most extreme kink and that wouldn't matter. It's not about what kind of sex the 2 people have.

None of us women are doing that.

Your son will never have sex if he follows your advice. This is a very embarrassing and LSUCOYOTE type of post.

First off I agree that that the escort route is dumb and I assume was a comment made at lease 80-90% tongue in cheek.

Now onto the next part of consent....I can guarantee you that I will be talking about it clearly, succinctly, and often with my sons. They will have too much to lose not to talk about it. No piece of arse is worth ruining your entire life over. When you take a girl home from a bar today you have to be extremely careful even after consent it given.

In my day we didn't even think about it too much...I mean its pretty clear we knew when a girl was too drunk to have sex which mean we/I took her home and made sure she got into her home safely and GTFO....but today you hear too many stories of girls crying rape the day after and guys saying that they didn't think she was too drunk to consent. Like I said in my day too drunk to consent was clearly visible....I don't think that is the case today in many cases.

Obviously the Brooks case doesn't fall into this at all at least from what I know of the case.....a girl her size at .3+ BAC should easily be identified by any reasonable person as unable to consent...at least I think.

Madison Brooks Case - A Discussion Regarding Alcohol and Consent

At .318 BAC there is no discussion.

All there is, is just words trying to justify rape.

TOP’s doesn’t pay for escorts. Who’s going to finance this “escort “ every time the 18 year old gets a boner ?

Well sure this is best case scenario....and you do the best you can here....BUT I certainly didn't live by this rule every time....did you?
