I'm being cheeky.

Obviously I believe that the only speech that needs protection is offensive speech (including hate speech).

No one wants to ban what they agree with.

Is that in America or in an American's yard?

So under your logic, burning a cross in a black pereon’s yard should be protected by first amendment?

If the person burning the cross is in the black person's yard without their permission that is trespass. Otherwise I believe burning a cross that doesn't pose an imminent threat of death or bodily harm then is legal.

Pretty much sums it all up in a nutshell, I personally think we should ban American flag burning and the fact Texas v. Johnson was 5-4 really maintains the topic as open and renders that decision as subject to question, the American flag's a unique representation, symbol. It transcends politics and denotes allegiance not only to a country but to a way of governance that's likely the greatest in the history of the world and should be protected beyond all measure. Moreover, I could go hardcore textualist/originalist on all of y'all and argue that the 1st Amendment doesn't protect symbolic speech, don't think anyone when the Framers drafted the 1st Amendment ever interpreted speech beyond the oral production of words like my legal spirit animal Hugo Black maintained his entire SCOTUS career. It is what it is.

"free speech" - "Burning flags"!
Are we a country of fire breathing dragons now!
or do we now just identify as such?

The best is how he's for government protecting us from corporations but goes into every Facebook thread telling everyone to start their own Facebook. Dudes an inconsistent chode.

At this point, I'm more concerned about keeping the second than the first as it appears that most of our free speech in the near future will have to be in Morse code.

Gee Dale.

One is destroying something I care about as a means of protest.

The other is terroristic threatening.

But you knew that.

TIL that for the first 50 years of America the largest religious ceremonies were held in the Capital Building.
Apparently the founders didn't have the same opinion on 'separation of church and state' as we do now. But what did they know, they just wrote it.

When you LWNJ peons start caring about 2nd and 4th Amendments, you'll have an intellectually honest leg to stand on. Until then you are nothing more than low-IQ parrots with weak gotcha arguments.

A weak argument is the one that says burning a flag should cost an American their freedom and/or their citizenship

This board isn’t quite small government. The fact is many people only want to protect speech that they agree with.

Surprisingly though the Donald seems to be against this but this board isn’t.

Do you idiots understand an amendment to ban flag burning would not be unconstitutional? That is what the amendment process is.

Has nothing to do with big government, has a lot to do with the significance of the flag and constitutional interpretation, if SCOTUS really wanted to make a 1st Amendment statement relating to flag-burning, they'd have rendered a unanimous opinion in Texas v. Johnson, they didn't 4 justices dissented INCLUDING noted liberal Justice Stevens and noted moderate Justice O'Connor. A "plain meaning" interpretation (textualist) of "speech" represents the oral production of words, period, point-blank.
