If any specific individual is found to have used the autopen to sign legislation, EOs or pardons without any documentation backing the assigning of such authority (it would have to come from Biden himself, or at least his Presidential email account), the DOJ could (theoretically) charge them with impersonating the President. We know that no matter what the finding of a lower court, there's going to be an appeal. At that point a Writ of Certiorari could be filed and, hopefully, picked up by SCOTUS.

Someone needs to follow the money. It's been clear in my mind that the autopen pardon signature was for sale.
