Legally it shouldn’t matter. But Austin is a liberal shithole so they’ll probably drag him through the process unless the state AG intervenes.

“BREAKING: Austin police have confirmed that two people opened fire during a shooting in which a man identified as Garrett Foster was killed at a downtown protest. Investigators are still trying to determine what charges they may face.

UPDATE: Officials believe one shooter was the driver of a car, and the other was in the crowd and may have opened fire on the car as it drove away. The investigation remains fluid, but this is the account police have right now of what happened.

Plenty of security cameras around on that street and ballistic evidence, truth will come out eventually

First eye witness accounts are already disputed by direct video evidence so really nobody knows anything other than:

car in crowd.
guy with gun near car.
8 shots (5, pause, then 3).

Everything else is just a guess

I've read "warning shots" but the new one is "he was firing to disable the vehicle so no one got hurt"

I mean..............

He fired in the general vicinity of someone putting their life at risk. and destroyed their property

If that’s the case, then the driver unloaded 5 shots in to Garret as he approached the vehicle.

This supports the still image earlier in this thread. Looks like Garrett is holding the AK downward. Wouldn’t make sense to fire 5 warning shots downward.

Then after 5 seconds or so, another armed protestor draws and opens fire on the fleeing vehicle.

Can the shooter still walk given Garrett had the gun coming up to the car?

Yet every eyewitness account the news ran said the driver shot Garrett three times...
