Wow, didn't see this, and just posted it as a 'Muh Dictator' policy in the 'Senate Race' Thread.

A lot of illegal immigrants used the 'rent a kid' mechanism when they filed papers to enter the US. And are likely getting Benefits accordingly. Blatant Fraud, and now way they should be able to use a childbirth since entering to stay in the US. Of course, there could be mitigating factors, gainful employment for starters.

I was also thinking it would take an amendment to the constitution. I might be wrong though...

That is exactly what he is doing and probably feels good about his chances while we have a conservative SCOTUS

Not a fan of every thing having to be done by EO, but Congress is feckless. So if this puts it in thr spotlight and forces Congress’ hands to be active FOR our country, then EO away.

I hope he really does it in this term. IIRC last term he floated a lot of trial balloons about signing an EO to stop birthright citizenship but was thwarted by advice from his DOJ.

We'll see. This is why the appointment of the right and proper AG is so important. He and Trump have to be on the same page.

He needs an AG that is willing to fight this issue. Last term he did not have that.

Possibly. I don't know if that issue has fully been decided by the USSC. But that's the underlying reason for the EO...to try to get the issue before the USSC. He knows adverse groups will challenge the EO

Even a Scalia type would probably strike this down since it's made so clear in the Constitution that anyone born here can be a citizen. But what the hell. They do it. Playbtheirnstupid games, too and see what happens.

Unlikely on this issue.

You have three, three wacko liberals who will love anchor babies.

The conservatives are a mixture of originalist and textualist.

They will very likely split on this issue meaning Trump doesn't have the numbers.

But it's certainly worth a shot.

He promised this last time. Birthright citizenship for anchor babies is a myth - it's never been a law, it was a footnote in a SCOTUS opinion. It's not a holding. It's not even dicta. This EO is all it takes - let them challenge it in court then tell the courts to pound sand.

No, it will take Supreme Court clarification, which this EO would force.
