The police didn't arrest those people for no reason. My guess is the installation was fricked up, but deranged leftists also vandalised it.
In that case, it would be hard to prove in court what was from the faulty install and what was from the vandalism, so they dropped the charges.

If she can get a conviction, but when the Dept of Interior admits to faulty install leading to issues, that makes it likely it will be an exercise in futility and a giant waste of time and money.
She went and got the grand jury indictment, but that was before the DOI letter admitting problems.
