When you are getting deposed about tax and finance stuff that is super complicated, and hard for laymen to understand, you should always take the fifth. It is so easy for prosecutors to make statements about complex topics incriminatory.

The NORMAL way to "get around" that problem is for the Defendant to ask for an abatement of the civil action, until completion of the criminal case. This situation is unusual, in that no criminal case has yet been filed (of which I am aware), and you will have a hard time convincing a judge in a civil proceeding that he should abate all proceedings in his pending case, because you think that some jurisdiction somewhere MIGHT be considering the filing of a criminal action.
The judge would laugh at you.
That leaves you with having to CHOOSE whether to accept that negative inference in the civil case, in exchange from protecting yourself in a later, still-hypothetical criminal proceeding.
Trump was put in a tough position.
