Was, is more accurate, and he's old (70+, maybe 75+) and had some major health problems that caused a big mental decline. Like, I think he's almost died a few times.

Here is another historical example of the usage

Senator Kennedy made a fool out of her at her Senate confirmation hearing. When asked what her main trial experience was in......she said it was in workers compensation suits. Off the record, he said she was the dumbest judicial candidate he had ever cross examined.

I guess Kennedy is a "smooth brain," because he also wasn't smart enough to figure out she was simply being "clever."

Not to mention the fact that he also wasn't smart enough to figure out that the "I'm not a biologist" remark was ingenious.

You don't need judicial experience for the Supreme Court. Or trial experience, really.

Appellate work is a different ballgame and she was Solicitor General of the US which is much more impactful than trial court experience (as a judge or litigator)
