You defeat your own argument. Anomalies and deformities of the two sexes are just that: anomalies and deformities of the two sexes. They don't magically create some third option.
Understand this, "sex" in humans is determined solely by whether that person's biology is geared toward producing eggs or producing sperm, with other biological aspects (height, strength, muscle density, etc) supporting or being associated with one or the other. As such, there can be no "other" options.
For ovotesticular disorder of sex development ("OT-DSD," which is the new clinical term for "hermaphrodite"), they are often sterile with their deformity normally having a more developed (thus more dominant) set of sex organs and a weaker one (most often the female organs are the more dominant). Even the rare exceptions which are not sterile are only non-sterile through one set of sex organs (the dominant one), not both. Thus, they are either male or female.
