According to the WaPo:
The state court said such ballots must be counted if they are postmarked by Nov. 3 — and even if they are not, “unless a preponderance of the evidence” shows that the ballots were mailed after Election Day.
What I don't get is that if the ballot is post-marked November 4, how is it not res ipsa loquitur?

This right here. The real challenges will come in the days after the election and the boxes of “lost” ballots that turn up
ACB will wreck it with the quickness.
