After this term, Justice Barrett seems closer to Thomas, Alito and Gorsuch than the Chief and Kavanaugh.

So both West Virginia and Texas tomorrow. Interesting.

Held: By ratifying the Constitution, the States agreed their sovereignty would yield to the national power to raise and support the Armed Forces. Congress may exercise this power to authorize private dam- ages suits against nonconsenting States, as in USERRA. Pp. 3–16.
Seems like the 11th Amendment (which was added to the Constitution AFTER the ratification of the main text - which included "raise and support Armies") would have prevailed.

My guess was that they are allowing Breyer to have his "day" with his last opinion in a weak session and then will drop the last two "big" ones tomorrow.

interestingly... Gorsuch writes the dissent joined by the libs
Not surprising at all. Gorusch is big proponent of Indian sovereignty and holding the U.S. accountable for historical agreements with tribes. His dissent in this case is blistering. You can also read McGirt to get an even better understanding of his view in these cases.

Couldn't agree more. I hate EOs. I was merely asking to make sure I understood this correctly.

Breyer wrote the Texas case about the powers of Congress to raise a standing army and navy, and to enforce payments from states via suits.
