The epa and the Dept. of education are Satan's spawn.

Congress should pass a law and say Hey, EPA - here's the law we passed. We grant you the power to enforce these laws and regulations. Instead, the EPA is just making shite up and enforcing it as law. This has to stop.
This is how they should rule. Laws on the books will be kept in place so we won't have literally thousands of regulations thrown out this afternoon, but they can be changed by Congress.

I pray that this results in a proper gutting of the "AFT"

But, you could be right. I don't know how you possibly go back and determine where the overreaches occurred all these years. It's gone on way too long (under all administrations) but congress gave these agencies certain authorities. That all needs to be revisited post haste.
Will this effectively jettison tens of thousands of regulations made by govt agencies? Will this result in the loss of what some might call good regulations in the area of consumer protection or investment matters?

I think they rule in favor of WV, but I don't think it will be anything groundbreaking. They will make it narrow in scope, kind of a light warning to the administrative state more than anything.

We can certainly include CDC over the past couple of years.

I am all for WV winning the case and seeing a scaling back of power of the administrative state. I am just concerned how it is operationalized if they rule for WV.
Our legislative branch has become addicted to not legislating and by forcing them to actually legislate these major policies, we could now change a set of bureaucratic overseers for instead a block of lobbyists that have prewrote regulatory bill packages

The end of Chevron deference would be a massive gamechanger.

Wouldn't it, though! If they overturned Chevron (1984), I may go celebrate in the streets.

quote:Absolutely. I'm most curious if the EPA had authority to impose such draconian O&G restrictions or was it EOs just carried out by EPA. Too many to count so it could several agencies; EPA, BLM, Dept of Interior, on and on.
We can certainly include CDC over the past couple of years.

I would love to see these decided in the vein of curtailing federal bureaucratic power, but I think we may have hit the limit on wins this session. I can't see Roberts allowing the expansive Roe decision, re-establishing limits on state firearms laws and then follow that up with neutering of federal agencies.
I hope I'm wrong and we can just leave our money on red for one more spin.

Is there a limit on how many wrongs to be righted? If the worry is that it will look like sabotage by the courts, then maybe the view should instead be that we have been sabotaged by our legislation first.

Tea leaves say that Roberts is writing the West Virginia/EPA decision,
I hope this isn't true. If so it's going to either be an extremely watered down decision or he's going to side with the libs. I'm praying for Thomas or Alito and getting rid of Chevron

From SCOTUSBlog:
If you're an EPA administrator, what are you doing right now? Packing your desk? Working hard until 10? What is being in an agency like at this point?
