Much of this advantage is just perceived (at this level, at least) because of how retarded both Trump admins have been in terms of governing.

This EO was incredibly stupid and not thought out well. Intelligent people told you this the day it was issued. However, it got the emotional reacts form the Ow! My balls! crowd, which I assume was the intended impact. Serious lawyers would not have written the EO in this manner, setting themselves up for such anticipated failure. That example is not displaying an advantage for leftits.

The fact that he wrote a 91 page dissent for this monstrosity of a decision on birthright shows how absolutely infuriated he is.

It's sad that his dramatic emotional-partisan shift at the end of his storied career is going to define so much of his legacy.

2) No TSA flights for any foreigner into the USA if pregnant
3) Restrict VISAs from China ???? and Birthright industry countries into the USA for women until they stop abusing our constitutional law to exploit the 14th Amendment adopted for the children of slaves!

Let’s go Trump!!!

Let’s see immediate TSA/DHS pregnancy test screening for all NoN-USA women flying into the USA effective immediately at their expense! Thanks to SCOTUS!!

Ohh, so allegiance is what matters, someone should try to make that argument in court. We could call it IDK.... sovereign citizen.

It's as unambiguous as "shall not be infringed."

Define "lawful jurisdiction thereof". There is zero context provided in the text.

Hmm, perhaps the crafters of the 14th had thoughts?

Everyone is partisan. It's just a matter of how you hide it.

Anyone marginally principled should agree that an EO can’t override the constitution

That said, id support Congress fixing birth right citizenship.

Oh, I knew this EO didn’t have a chance in hell.

I posted that numerous times.

Has Congress always been inept at getting stuff done? When did the rush of EO start because Congress wouldn’t act how they are supposed to? Has it always been that way?

Suppose that a person's only connection to this country is that he was born here to a mother who was present just long enough to give birth and then quickly return to her native country.

Suppose that country is a strategic adversary or enemy of the United States. Suppose the child never visited the United States while grow and was inculcated with hatred of this country.

According to this court, now, that person is a citizen of the United States. He can enter and leave the country as he pleases. He can travel the world on a US passport.

Even if he plots to harm this country, he cannot be deprived of his status as a citizen, at least under current precedent."

The word "lawful" doesn't appear in the 14th. Unambiguous doesn't mean it is spelled out within the text. Words have meanings, and courts should give those words their common meanings when interpreting statutes.

Trump is wrong. Shocker. Stephen Miller probably told him that was the outcome from today.
