You’ve got a substantial misperception of how it works. First of all, it’s more often than not state and local authorities that utilize the law. Second and the more important misperception you have is that there is absolutely due process afforded the individual.

But if you stop and take a moment to consider the circumstances under which this law pops up is, for example, an emergency call to the police from someone who has come into personal knowledge that a particular person is in the process of a meltdown, has indicated an urge or plan to go out and take some people with him, be it a school, an ex spouse and kids, some other specified person(s), etc etc. There are endless possibilities and examples.

It should start to make sense that going through a series of technical steps instead of going straight to address the alleged threat and protect both the individual as well as alleged potential victims is neither rational nor moral. That’s the unfortunate reality of our world today, and the way they do their best to balance it is that once the immediate potential threat to life has been negated, the next priority is to bring the matter in front of a judge within a set brief period of time, talking a matter of a day or two, where the burden is on the government to show the necessity of further action, at which point the judge rules either necessity of continued action, or “release tje person and his property.” And that’s that.
