You realize that the opinion was 5-4.

Constitutionality just depends on the partisan lean of the court.

If there had been 2 more liberals on the court, I could easily turn around and say it's constitutonal.

Constitutionality seems to be a meaningless term if it just depends on the make-up of the court.

The federal government doesn’t unilaterally decide who can do business. They can’t just take away your ability to do business. The federal government isn’t an all knowing being, and that’s why we have negative rights against the government.

Obama's a private citizen. If the government isn't preventing him from holding a birthday party, I can't make him. It's the role of government to decide whether Obama has breached guidelines or not.

As I've said, he's a private citizen. If the government is allowing him to do it, I'm not sure I can do much to stop him.

Change the word Obama to Trump in your statements above and then just imagine the reaction from the DEMs, the MSM, the SJW social networks, et al. But most of all, try to be honest and predict what your own response to that situation would be.

Your 'but I can't do much about it" is of course true - but totally irrelevant. The only point worth discussion is the hypocrisy of the situation - whether or not some individual can do anything to change the situation.

I mean they can.

Lockdowns were constitutional according to the judges in Michigan and Pennsylvania.

If the supreme court had 2 more liberals, I can almost be confident that lockdowns would be considered constitutional.

Government can grant rights. Constitutional amendments wouldn't exist if federal governments couldn't give or take away rights. If 2/3 of the senate and house agree, a constitutional amendment could pass banning guns for example.

Government granting rights has nothing to do with the free market or not. First of all, no markets are free as government regulates the market. Secondly, this regulation means that government lets you do things.

Legislation wouldn't exist if government didn't 'let you do things.' Regulation means that government 'lets you do stuff' - the government could regulate that stock buybacks are illegal tomorrow. That's an example of government restriction.

TLDR: Government regulates what you can do. If markets were truly free, there would be no regulations. Therefore, government absolutely controls your rights.

Absolutely.

I think government can take away freedom of speech if they so wanted. Constitutional amendments can be repealed - it's extremely difficult and unlikely but that still means it's a possibility.

It's not something I agree with but I do think they have that ability.

You realize the 5-4 was ruling it constitutional you absolute moron. The supreme court ruled it constitutional - some guy just said that Kavanaugh was being an idiot. It completely supports my point of view.



Did you even understand the points being made? I'm guessing you don't because intelligence probably isn't your strength.

I was just pointing out that constitutionality is meaningless (even though it currently supports my point as the supreme court ruled it constitutional).

I said that government grants rights which included both local, state and federal governments.

Wrong, AGAIN.

5-4 did not rule it was "constitutional." The case was about lifting a stay and 5-4 (f*ck John Roberts, AGAIN) ruled that they wouldn't lift the stay.

THAT'S IT.

Kavanaugh issued a concurring opinion that FLIPPED the actual 5-4 vote on Constitutionality to hold that what the CDC did was UNCONSTITUTIONAL. He just threw the Biden administration a bone and said he would leave the stay in place because it was coming to a natural end soon. He told them if they wanted anything beyond that they would have to do it in a CONSTITUTIONAL manner through the legislature rather than the UNCONSTITUTIONAL manner of having the CDC write their own laws AGAIN.

Further, even if Congress had done something, the Supreme Court did not rule on whether this is an unconstitutional TAKING that is also in direct violation of the Fifth Amendment.

SERIOUSLY, quit while you're so far f*cking behind and stop making a complete f*cking a$$ of yourself.
