Be guilty of 2nd degree and 3rd degree murder seems it has to be one of the other.

I hope this is true. It guarantees reversal on appeal

C'mon, once they came back with in hours, instead of days, they had their minds made up.

Waters, Biden, and Liberal media made sure this would get the worse of charges. They MADE sure of it.

Now...the judge did not grant the mistrial, but I wonder if he will reconsider his mistake and toss the verdict?

This is how the media powder kegs the lemmings. Put out false information from a "confidential source", people eat it up, and when less than that happens - they have their next endless news cycle.

No. He's already set them up on the record. He flat out told the defense they had a case in appeal but he doesn't want to blow up this entire trial at the 11th hour

My thought too. He'd rather let the appellate courts deal with the mob.

Just the sort of rock solid jurists we want

BBC is guessing because nobody knows, but after looking at the statutes, he could be found guilty of all 3. They don't exclude each other.

2nd Degree Murder - caused death w/o intent during a felony

3rd Degree Murder - caused death w/o intent while "committing an act that is eminently dangerous to other persons while exhibiting a depraved mind, with reckless disregard for human life"

2nd Degree Manslaughter - Negligence where a person creates an unreasonable risk and consciously takes the chance of causing death or great bodily harm to someone else

I apologize to the board, I thought BBC might be less biased but they just went to Rep. Hank Johnson for explanation. Realized that I had originally made a mistake to give any credit to BBC.

The charges are not mutually exclusive in this instance.

How could one get three separate murder convictions on the same death? There's only one body.

I don't believe he can be guilty of both.
