Obtuse probably said it better, when he said that this prosecution is IDEOLOGICAL, with that ideology being the notion that citizens not exercise this sort of self-help but instead rely upon law enforcement.
Which isn't ideology, it's just stupidity given that the courts have repeatedly ruled that the police have no duty to protect.

Heck, even if courts said the police had such a duty, you'd need to multiply the number of cops by at least 10 to even hope to create a situation where a cop being on this scene started to reach "likely". And, I'll be my house this prosecutor is not in support of such an action.

Well-written advocacy for a broader concept of the justification defenses. Personally, I come closer to agreeing with you than to the position reflected in New York law. Eggs and omelette, right?

But the US is still (arguably?) a federal system, with each state able to enact laws that reflect the ideologies and mores of its citizens.

New York has codified the belief that bad things will happen more often if Joe Citizen can use “deadly physical force” with impunity than will happen if that right is restricted. If you disagree, don’t live in NY.

That is again, because if ivory tower morons who have a horrible definition of "bad things".

You see, how many "bad things" there are isn't just a result of the total number of bad things. Rather, it's the total number of things we call "bad".

When the ivory tower idiots start counting, their total includes all of the people who end up dead after creating the situation that led to their death. Meanwhile, these same ivory tower fools do not count(because it's hard), ANY of the people who end up dead, robbed, raped etc etc because criminals feel emboldened by the state's defacto defense of them.

Every time some citizen is harmed while able bodied fellow citizen watch too scared to become the next Penny, is a "bad thing" the ivory tower person will never count.

Meanwhile, when I tally up the number of "bad things", I don't even need 1 finger to count up how many "dead cause I caused it myself" people there are.

Hank would be attempting to dazzle you with the intricacies of the wiring while the house burned down.

Ran across this 1968 painting by Mort Künstler.

What Penny did used to be heroically depicted. How times have changed.

Another dumb part about going after Penny is that basically, it criminalizes effectiveness.

What it, instead of dragging the dude down and holding him down by the neck, he'd simply thrown a stiff right cross and the guy died? It is perfectly possible for a strong man to kill another man with a bare fisted punch.

Penny had the guy subdued and, well, now we know taht Penny is NOT an expert at knowing for sure if the other guy is gonna die during the subduing.

Oh fricking well. He shouldn't have to be an expert.

In the old days of the west we would take a couple strong horses and tie ropes around the bars of his outside window and free this man.

Victims lacked dark skin pigments so it wasn't a crime.

I would have refused to arrest and made a speech outside of the police station/DA office calling this a sham and asking people to take to the streets.
