She is accused of three things:

Listing a secondary home as primary
Listing a 5 unit rental as 4 units to qualify for lower rate loan
Listing her dad as husband to combine income for lower rate

All three have her better terms than she would’ve gotten otherwise.

If all three are true it’s going to be hard for her to plead no intent.

How much did she defraud the state in lost property taxes? Without homestead exemption, taxes are quite high

This is not petty. Just ask those who have been prosecuted for the same thing. The warning of committing mortgage fraud is very much stressed to all real estate investors from Realtors, lenders, and title closing agents. It is on multiple documents signed at time of application and at closing.

There is no way she did not know what she was doing. She just thought she could use her law license as a weapon to avoid being prosecuted.

If she gets off then then they should just remove mortgage fraud from the books because no one should ever be prosecuted for it she is not convicted. There is no talking yourself out of signed documents.

I think she knows her fat goose is cooked. If she tries to fight this, Discovery is probably going to lead to the DOJ bringing further charges and stacking other cases against her. I don't think RICO is out of the question either.
