I think it changes it from Murder 1 to Murder 2.
His emotional state/fear/passion made him irrationally interpret the situation and he killed a guy that normally people wouldn’t think is a lethal threat. He still can’t really claim he had reasonable ground for self defense. You can’t shoot people who have a gun and slap you just because they have a gun.

Post the still shot of him reaching for the spray. Everything I saw ran to the contrary and I’d like to know if he was reaching for the spray for sure.

I see that video but if you look at it from 6 feet away you can see his hand clearly go for the bear spray.
Also the victim was right handed and had a can of bear spray in it. His weapon is on his left side. Meaning he would have to reach all the way around his gut to pull it out...

Now the person that enhanced those pics claimed that area was intentionally darkened. I do not know if that is the case or not but the claim was made.

No. Any trained security officer would draw down and demand compliance, not pop off a round into someone’s face. Lethal force must follow a reasonable threat to life.

One thing I’ve learned from this is that holding a spray can in the hand you’d use to draw your gun is a lethal tactical error.

Even more reason not to use lethal force. Is Keltner going to drop the mace can, reach across his body, unsnap his holster, draw his weapon and then fire? Was Dollof psychic?

That’s another good point. Even if he knew he had a gun, he had no way of deholstering it without first dropping the spray can...which he didn’t do until he was dead.

That was perhaps a reasonable supposition 48 hours ago. A lot of video has become available since then, and NO ONE who has studied it still thinks any of this is true.
A) There is zero evidence to come to the conclusion you just laid out. We have no evidence as to Dolloff's actual intent.
B) Whatever Dolloff's actual intent, Keltner's interpretation of his abrupt physical contact may well have assumed intent to go for either mace or even his pistol. Justifying the response.

When Dolloff inserted himself between Keltner and the reporter (and at least attempted place his hands on Keltner's chest, perhaps more), Keltner could EASILY have interpreted those actions as aggressive, justifying him in striking Dolloff.
Just another of a series of entirely-reasonable reactions in a stressful situation, all of which snowballed to a tragic result.
Again, sometimes bad things happen without anyone committing a crime. We are all human.
