Do according to this Obama POS, yes, Abrego Garcia was trafficking. Yes. he was here illegally. Yes, he beat women for purpose of intimidation, including his wife.

This shouldn't effect his deportation in any way.
The remedies if the judge finds that he WAS the victim of malicious prosecution:
1) prosecution might be dismissed
2) might serve as a basis for subsequent CIVIL suit by Abrego Garcia.
The judge should be admonished by the Appellate Court.

I went and found the actual order... you can read it here.
So... what I'm reading so far, it seems like the "vindictiveness" angle is due to Noem and others' statements as this case has weaved back and forth. Also, his TN Homeland Security Investigations case on human trafficking was dropped days before his ES deportation. Once he was ordered and returned, it was reopened.
This last order is bullshite... but its basis is government official smack talking and reopening a dropped investigation.
Whatever comes of this, maybe the government learns that moving forward, premature celebrations aren't a good strategy.
What I *don't* understand is how ANY of this would preclude Kilmar's expulsion from this country. Facts are facts, no matter which government official says or acts about it. He doesn't belong here, period.

I know I'm considered a bad guy or even worse...a DEMOCRAT...for being curious, but why DID DOJ decide to bring him back for prosecution?
He was safely and permanently beyond the jurisdiction of the US courts in El Salvador. ZERO taxpayer time or money would have been spent if he we didn't pay to retrieve him from El Salvador on charges that the Trump Administration never intended to pursue. Everyone agreed that he would just be deported to someplace other than El Salvador if he were brought back to the United States.
I think the Judge's actions are out of line, but it would be interesting to hear the DOJ's reasoning in opening up this can of worms by paying to bring him back. It also exposed the legal fiction that we couldn't bring him back from El Salvador.

I don't agree with the term malicious.
Would you fault a prosecutor for remarks celebrating the successful prosecution of a murderer? Taking pleasure in righting a wrong isn't necessarily malicious.

It sounds like they either had to, or were nearing having to bring him back- so they decided to use the recently closed case to pin on him upon his return.
I *think* the HSI case was closed to speed along his deportation- having an open case in the US was in Kilmar's advantage.
