I don’t blame Kelly for wanting $43m upfront. It was also the right decision for LSU to reject it.

It was easy for Kelly to say he’s open to settling “if it makes financial sense” then offer a settlement option he knew LSU would reject outright. He can say he offered a settlement, just not a very realistic one.

If the parties can’t agree on a settlement somewhere in the $25-30m range, LSU would be better off to pay out the buyout as contractually required and Kelly’s new earnings will count against it.

No need to play chicken. Attempt to negotiate in good faith and if that fails, honor the terms of the contract and move on.

LSU has the duty to inform Kelly 7 days prior to the effective termination date in the case of for cause termination. There is no effective termination date of the contract yet, so how can it be after the fact?

To be clear, I don’t think there’s for cause grounds here, but no one on this board is privy to any of the actual details.

If it matters, the way the news initially broke was that LSU notified Kelly of its intent to fire.

We’ve no way of knowing if or how that happened, but Kelly is still on payroll, unchanged from before all this happened.

And people need to take a breath. Parties negotiate settlements and damages all the time. LSU hasn’t breached anything, but trying to negotiate here is the prudent thing to try and do.

If Kelly rejects all offers he’ll get his money. It’ll be a cold day in hell before LSU lets this get ugly and I see no chance this goes to court and LSU attempts some smear campaign on Kelly as some fans have suggested.

How many years? Kiffin likely isn’t leaving OM without a generous contract term, so you’re likely looking at 7 years minimum. At your recommend $14.5M, that’s over $100M.
