Justice Kavanaugh May Have Handed the United States a Roadmap to Fix Birthright Citizenship

Justice Brett Kavanaugh joined the majority in striking down President Trump's executive order but wrote separately in partial dissent. He concluded the order conflicted with existing federal law, not that it was unconstitutional. In his opinion, he also outlined a framework for addressing concerns surrounding birthright citizenship through legislation, making clear that any path to lasting change would likely require an act of Congress.
quote:
"Significant illegal immigration into the United States is a new circumstance that was largely unknown as of 1868 and that the Framers of the Fourteenth Amendment could not have fully anticipated," Justice Kavanaugh wrote. "And the Framers likely would not have anticipated (and presumably would not have intended) the odd result of granting a substantial birthright citizenship benefit to (i) those foreign citizens who violate U. S. immigration law and illegally enter or overstay and then have children in the United States over (ii) those foreign citizens who follow U. S. immigration law and have children in their home countries while seeking to lawfully immigrate to the United States. Nor presumably would they have wanted to grant constitutional birthright citizenship to children of foreign citizens unlawfully in the country while simultaneously denying constitutional birthright citizenship to children of tribal American Indians."
quote:
"Consistent with the Fourteenth Amendment, Congress could amend §1401(a) or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country," he added. "But Congress has not yet done so."

But ... muh ... he was sposed to fix it hisself. Right?

No, he didn't. People have to stop covering for them. They ruled wrong.
The birthright citizenship problem is so entrenched that they're electing their own people now. There aren't enough votes to fix it.

fixing birthright citizenship won't stop the judgment coming for murdering fetuses and massive perversion.

Hell yes! We need dictatorships and appointed officials making laws. Don't need no legislative expectations!!

You Westboro folks should know your time is over.

To borrow a liberal talking point, there is no way the founders envisioned a time when someone from a third world shithole could get to America in less than a day while deep in pregnancy just to give birth here.

Nah.
He’s just a pussy and didn’t want to rule in favor of something so controversial.

Common sense. But common sense doesn't exist anymore in this country.

I agree with him on this 100%.
It seems very apparent to me that birthright citizenship was never the intention of the law as it was written to address the slavery issue.
But that law was poorly written if my assumption is correct.
I am 100% against judges ruling on what they SAY was the intent of the law. It is and never has been (even thought they do it sometimes) the job of a judge to interpret the intent of a written law.
It is not their job to MAKE law, it is their job to enforce law as it is written.
I wish all judges would go back to doing their jobs correctly. Communist judges I am looking at you.
If you right a law, write it correctly. If you are too stupid to write a law as you intend... then shame on you for being a dumbass. A poorly written law has damaged this country and congress should act to fix it. They won't because congress is full of selfish disgusting evil people.

Lol, now we have a SCOTUS that wants to legislate. Maybe POTUS Trump writes another EO that does not conflict with existing federal law.
Until lawfare goes away, POTUS Trump must use EOfare!!

This is dumb. You have to interpret for intent of the law because meanings of words change over time.
Also, it wasnt poorly written at the time, they just ignored what was written. Subject to the jurisdiction is in there, and if you just look up what they meant by that at the time.

The only thing our politicians agree on is when their vacation starts!

I think you're mocking the people who might respond in this way, but I literally can't. Everyone I vote for would absolutely pass such a bill right now.
