so any idea when the judge will rule on the motion to dismiss since the prosecution withheld evidence? He made mention of it when they were ruling on the jury request but he didn't say when he would rule.

Probably not anytime soon. He admitted he hadn't even read it. It's crazy that he will probably allow the jury to review the video in question before even reading the motion to dismiss.

If there are one or two holdouts can the rest of the jury ask them to point to the specific evidence that makes them believe it’s not self defense. If those jurors refuse to answer or answer with some bullshite like I don’t like guns or he was there to start trouble can they turn that over to the judge that they are not deliberating in good faith.

I'd have yelled if that happened to me. Nobody is ever going to point a gun at me like that.

Biggest trial in the country and of his career as a judge: and he hasn't found time to read a four page motion to dismiss? Something doesn't add up here.

Why would the State not use the "HD" version of this video and image other than to lie and obfuscate about what is happening and what Kyle did.

I also would've struck any juror who was wearing a mask during jury selection.

I was listening to a recap on that and they framed Binger as pointing the gun as bait for Richards. If richards had objected or made a huge deal about it, Binger would then been able to say “see how pointing a gun at you provoked the defense counsel”? It literally would have given the prosecutions theory real live legs in front of the jury.

I would need to know the rules of the courtroom. Maybe only unvaxed had to wear masks.

Me too. I don't think there's any way they convict him. A hung jury is the worst that can happen here. If they convict, it's been a masterful jury selection coup for the Left.

Correct. At the very least it would have gotten me to stand up and give a fairly obvious, "What the frick?!?"

I was wondering the same thing. It's seems very prudent to the video the jury has asked to see.

This judge is scatterbrained.

...and has the jury gone back to deliberations yet?

It seems ridiculous that a jury can view a video when there is a motion for mistrial heavily based on the drone video and it isn't immediately ruled on.

The fact that that video is being relied on at all is pathetic.

This judge is a Dem appointed to the bench by a Dem.

My cynical suspicion is that he’s been play-acting impartial and the consistent admonishing of the prosecutors has been for show.

I think he’s already read the motion but just wants to give the jury whatever it takes to drag this thing out, knowing that the more doctored video they watch and the longer they deliberate, the better chance of a guilty verdict happening.

Plus, the motion is very poorly worded and flimsy as hell. And now that the jury has already seen the doctored video, he’ll make an excuse saying it’s moot to dismiss when the jury is on the verge of a decision.

It all looks bad for Kyle. But he certainly will have grounds for appeal as a result of this BS.

I’m not sure this case was presented to a grand jury.

Yes, but through the foreman. If the jury is called into courtroom and is deadlocked the judge can query the jury and one by one they each respond to the question.

That video might as well be a magic eye where you have to cross your eyes to see the image. You can’t even tell who is who.

The longer this goes on, the worse for Kyle. It’ll be the most pleasant of surprises if he isn’t convicted of something.
