Last Wednesday we had another complaint heard at the Sunshine Ordinance Task Force (SOTF) against the SF Arts Commission.

The Arts Commission was supposed to get a written City Attorney Opinion for this hearing supporting it's position but they didn't get it even though it's been over 3 months since the last hearing.

The Task Force chewed the Art Commission's representative out for not having the written City Attorney Opinion and gave the Arts Commission one more month to get it or else they will make their decision without it.

However, we know the City Attorney won't give the Arts Commission a written Opinion because they know we are right and the Arts Commission is wrong.

This is the last complaint we are filing against the Arts Commission in front of the SOTF.

After this hearing, we will be hiring an attorney and will file a lawsuit against the City of SF, The SF Arts Commission and the City Attorney for embezzling all of the Street Artists Program's certificate fee revenue when from 1972-78 the City put all of the Street Artists Program's certificate fee revenue into the City's General Fund then refused to let the Street Artists Program use any of it claiming that once they put the Street Artist Certificate fee revenue in the General Fund, it was the City's money which they could use to pay for any of the City's bills.

Then in order to cover up the embezzlement, the City Attorney wrote several fraudulent Opinions asserting it was legal for the City to take all of the Program's revenue.

Then the City went to the voters and told them the City needed the power to raise Street Artist Certificate fees or else the program wouldn't have enough money to run it the next fiscal year.

Of course, because of the lie, the voters gave the City the authority to raise the Street Artist Certificate fees "when necessary".

Over the years, the SF Arts Commission and the City kept raising the Street Artist Certificate fee higher and higher but refused to use any surplus certificate fee revenue left at the end of the fiscal year to calculate the next fiscal year's Street Artist Certificate fee. They did that even though the formula used to calculate the next fiscal year's certificate fee mandates using all of the surplus when determining whether next year's Street Artist Certificate fee should be raised or lowered.

As a result, the Street Artist Certificate fee has never been lowered even when there was a surplus of money at the end of the fiscal year but was only raised higher and higher.

The City even raised the Street Artist Certificate fee one time when there was over $150,000 in surplus revenue at the end of the fiscal year and the cost to run the program for the next fiscal year was less than $150,000.

The Arts Commission and the City did this deliberately and the Street Artist Certificate fee got so high that many street artists had to drop out of the Program because they couldn't afford the higher fee.

The plan worked but, over the years, so many street artists dropped out of the Program that the Arts Commission didn't have enough money to run the Program even with the present certificate fee of $960 a year.

As a result, the last 3 years the City has been giving the SF Arts Commission hundreds of thousands of dollars each fiscal year out of the City's General Fund to pay for the Street Artists Program.

When the City did that, we confronted the Arts Commission with the fact that for over 40 years the Arts Commission and the City Attorney told the street artists that it was illegal for the Street Artists Program to get any money from the City's General Fund to run the Program, even the Street Artist Certificate fee revenue that the City put into the City's General Fund.

Now, over 40 years later, it's all of a sudden okay for the Street Artists Program to get money from the City's General fund to help run the Program.

The Arts Commission's response is to totally ignore us.

So, it will be interesting to see what happens at next month's SOTF hearing.

BTW, if you go to the SF Sunshine Ordinance Task Force website then you can listen to the entire hearing for your self. It is the last one and was held on April 3rd. Our complaint was about an hour into the hearing.

Omar and AOC sure do make one hell of a pair. Just when one of them has her trap shut, the other one comes along to take up the slack. The two are a never ending tag team of stupidity.
