I think we can all agree with that. Private spaces exclusively for men and exclusively for women are a good thing when done appropriately

They wouldn't exist if there wasn't a market for them. And my guess is the target is obese women who don't want to be seen in a gym with men. Obese men don't mind going to a gym with both sexes present.

It really comes down to private verses public. One big one was Augusta not allowing women membership, now they do but its still by invitation only. But Augusta is still private, legally they could still say no, but negative media attention and public pressure changed their policy not the law.

Another case was a SCOTUS decision, Roberts v. United States Jaycees (1984) and it established the distinction between intimate and expressive association, ruling that the Jaycees could not exclude women but only because the group's activities were not sufficiently private.

Legally they can deny services and you left off my second part about membership. A gym can be specific about what membership requirements they allow.

Nah. Public Accomodations discrimination does not apply to sex in the civil rights act.
State laws can apply though.

Honestly, Free Association oughta mean just that... Idngaf about sex, race, height, weight, whatever... If I wanna start a club for white girls 5ft or shorter I oughta be able to.

If I want to start a business catering strictly to afrocentric asexual ambidextrous acrobats, well, I oughta be able to do that too.

The only gym that would truly be illegal is a "white male" gym. Anything else is allowed to slide.

I don't think it for gender or race. There are all kinds of all women places, clubs etc. Male only places are the only ones that seem to have ever come under scrutiny.

About 15 years ago or so there was a Jane's Gym thing. All women. No one gave a shite
