If the administration wants to act illegally prior to "foreign affairs" having a role, that illegality can still be addressed by courts.

The ruse of hiding behind "foreign affairs" or "national security" can still be addressed at the above inflection point, especially if it's determined that a scheme to shield this illegality was concocted prior to execution of that scheme (which would be long before "foreign affairs" or "national security" would have a role).

"The state" is much larger than LEO, especially in terms of prosecutorial authority.
